The failure to yield the right of way to pedestrians is a three-point traffic offense. Further, it is one of the most dangerous types of traffic offenses given the likelihood of injury or death for a violation. A recent study reveals that NYC is the most dangerous city to be a pedestrian. The study disclosed that 31% of traffic fatalities in New York City involve pedestrians, more than any other city in the county. In fact, in 2008, 317 pedestrians were killed in New YorK City traffic accidents. In the State of New York, 23% of fatal accidents involved pedestrians. The report prepared by the Transportation For America, a safety advocacy group, concluded that New York misused Federal transportation monies by using only 1% of it to improve walking and biking safety.
