On the other hand, if you want to fight your parking ticket yourself, the following defenses may be raised to try and avoid being found guilty anywhere in New York State:


* mechanical failure

* theft of car

* medical emergency


NYC statistics shows that  a mere 13% of those issued a parking ticket actually fight it.  However, under a program which started in 2005, drivers who plead not guilty to a NYC parking ticket are offered a guaranteed reduction of most fines.  Let me say this again, if you plead not guilty you are very likely to be offered a lesser fine  and you don't have to prove or do anything. 

 

This settlement program is not widely known and results in the following savings:  $115 ticket reduced to $90; $65 ticket reduced to $43, $60 ticket reduced to $40; $45 ticket reduced to $32; and, $35 ticket reduced to $26.  All you have to do is follow the instructions on the ticket for entering a not guilty by mail and in about 30 days, you'll automatically get a letter offering the discounted fine amount.  For those without a good defense, engaging in this settlement program is a "no-brainer". 

 
For commercial vehicles, New York City has a separate settlement program.  Companies that enroll waive their right to a hearing or an appeal but they get their fines reduced (sometimes to zero) depending on the severity and location of the offense.
 

On the other hand, if you do not accept the settlement offer, you should know that statistics show it is better to fight it in person.  Just showing up and arguing your case in person makes a difference. Those who contested their tickets through the mail were 32% more likely to be found guilty than those who argued their defense in-person before a hearing officer.  

 

 

Finally, a former NYC Parking Violations Bureau judge allegedly took extreme measures to avoid paying his parking tickets (not recommended). Among other things, he obtained vanity license plates with the following numbers Y5OV26 and 4GZZ50. The theory being that these combinations of letters and numbers were likely to be mis-cited by a ticketing officer.

Fighting New York State Parking Tickets (outside NYC)

 

Any parking ticket issued in New York State (but outside New York City) must include the following seven pieces of information:


* date (month, day and year) and time of offense

* location of the offense

* the plate designation (as shown by vehicle's registration)

* the plate type (as shown by vehicle's registration)

* the registration's expiration date (month, day and year)

* the make or model of the vehicle

* the body type of the vehicle
